We released a report documenting the misuse of the Public Safety Act in the Indian state of Jammu and Kashmir (J&K). As part of this report’s release, I will be writing a series of posts on this blog (with actions that you can take) over the coming weeks highlighting cases of people whose human rights have been violated because of the misuse of the Public Safety Act in J&K. The report talks of how Kashmir is holding hundreds of people each year without charge or trial in order to “keep them out of circulation,” not by charging people with a crime, but just holding people because they can. In fact, the Indian Supreme Court has called this law a “lawless law.”
The authorities in J&K are using PSA detentions as a revolving door to keep people they can’t or won’t convict through the legal system locked up and out of the way. These arrests expose people to a higher risk of torture and other forms of ill-treatment.
The people who get detained include political leaders and activists, suspected members or supporters of armed opposition groups, lawyers, journalists and protesters, including children. Often, they are initially picked up for ‘unofficial’ interrogation, during which time they have no access to a lawyer or their families.
Over the past decade there has been a marked decrease in the overall numbers of members of armed groups operating in Jammu & Kashmir. But in the last five years, there has been a resurgence of street protests.
Despite this apparent shift in the nature of the unrest, J&K authorities continue to rely on the PSA rather than attempting to charge and try those suspected of committing criminal acts. This undermines the rule of law and reinforces deeply held perceptions that police and security forces are above the law.
Those held under the PSA can face up to two years in detention. But the Jammu and Kashmir authorities consistently thwart J&K High Court orders for the release of improperly detained individuals by issuing successive detention orders. Many detainees are thus trapped in a cycle of detention and remain, in the words of one high-ranking J&K official, “out of circulation.”
Oh and hey talk about impunity, the PSA provides immunity from prosecution for officials operating under it. Furthermore, the use of administrative detention doesn’t conform to international human rights obligations and agreements that India has signed on to.
We are calling on the Government of Jammu & Kashmir to immediately:
- repeal the PSA and with it the system of administrative detention, releasing all detainees or charging those suspected of committing criminal acts with recognized offences and providing fair trials in a court of law.
- end illegal detentions and introduce safeguards ensuring those detained are charged promptly, have access to relatives, legal council and medical examinations and are held in recognized detention facilities pending trial.
We are further calling on the Government of Jammu & Kashmir and the Government of India (the Central government) to carry out an investigation into allegations of abuses against detainees and their families, including allegations of torture and other ill-treatment, denial of visits and medical care, making its findings public and holding those responsible to account.
It’s time for this law to go and for the human rights violations to end in Kashmir.
Reading yur article, I couldn't help but feel that the Lawlessness of Law seems to be within the Law depending on how the Law is interpritted.
See, the USA along with their allies bombed Libya under 1973 UN law of Saving civilians. But, if it is the Civilians who are devided in to 2 parties are fighting against each other, obviously, one party with the government, the other opposing the government, Won't it also be an Internal affair of a country???

Its such a shame that Amnesty has proven to be a tool for US & other countries to meddle in the internal affairs of a sovereign state.There are many other places where people are denied basic human rights and jailed for long time like the Guantanamo bay and others but Amnesty dosent seem to think its wrong.

To those that talk about "interfering in internal affairs", I say guilty as charged! But, I don't understand at all why it's relevant. I realize that it comes from talking points, but I still don't understand why that would apply (even if there was some rule against it) to a human rights organization.

It is high time that AI and other international human rights organisations start paying attention to Indian-occupied Kashmir.
The Kashmiri people have suffered numerous atrocities under the Indian forces for the last 22 years. The sufferings have included the killings of nearly a 100,000 Kashmiris, more than 7000 people disappeared in police custody, thousands of young people tortured in prisons, thousands of women raped ….a society that is scared for generations… and waiting for justice….for their promised right to self-determination.
Kashmir is an international dispute and not an internal matter for India only. So sensible Indians need to start looking beyond this myth and propaganda. Those who have doubts should get some history lessons.

It carries out world wide campaigns against human right abuses, usually by spreading awareness and reminding goverments (including western goverments) that the world is watching. It does this through letters and petitions not bombs. I personally am from the UK and have taken part in many campaigns calling on my own goverment and the US goverment to stop human rights abuses both at home and abroad. AI has done a lot of work trying to protect human rights in the middle east for example in palestine and in the atrocious 'war on terror'. Contrary to what rahul patil says, AI is a major critic of Guantanamo bay and has been campaigning for its closure for years.

Why Amnesty International has not established yet national jurisdictions all over the world in order to control the crimes perpetrated unjustly in the case of Kashmir, Palestine and many other African countries?
The people’s independence are part and are walking along to this endless struggle for human rights. Why are not involved in international justice the most influential world countries like the U.S. or China? What’s this world power for? When they are betraying the people's fundamental rights.

I trust when you say "Guilty as charged", you meant the Government of USA and it's allies. We see double standards from USA when it comes to certain issues. They attacked Iraq for nothing and still that country is in dissarray and now they want to pull the forces out. We understand Afghan situ and fully support USA getting rid of the Terrorists there, but, now they want to pull out beofre finishing off the job.
However, in all instanses, many civilians were killed and we did not see many articles of AI against the GOUSA. However, we see many articles when it comes to developing countries like India, Libya, Sri Lanka when they try to solve their internal affairs. USA is basically poking in to other countries afairs and killing people of other countries where as the countries I mentioned are trying to solve their own issues. We might not agree with Dictatorship of Quadaffi, but, if we study politics right, there are several ways of ruling a country where Democracy is only one aspect. Socialism, Dictatorship, military government, Kingdom – all these have differnet approaches and it is up to us to acccept them. Just because we are from democratic nations, that doesn't mean that all the others should be too – that's us being more autocratic ya?

Even among the victims of Amnesty there are classes and categories according to political interests.
Investigate the judicial and police system Spanish, is for Amnesty far too hard and complicated, so often citizens are indiscriminately used through their time, suffering, anger and outrage of the citizens to get his own prominence and benefit.
It is very comfortable and popular that some notable judges have been engaged in digging up Franco's victims, they buried 30 years ago. But not for to fight the serious problems that society is currently suffering On our society.
Only some privileged people have secured their royal box from which to interpret or misinterpret the reality as it suits them best.
Next step, I Would like to add a report on the continuing violations of human rights in Spain, where Amnesty has not moved or never move a finger because it does not suit you.

Participants, the OPSHR will be ready to present to the European and Spanish
authorities, in addition to UN agencies) a very extensive Report on the level of respect for human rights in Spanish institutions of segregation, with special reference to torture and other cruel, inhuman or degrading treatment or punishment.
Finally, it could be remarked that the past this constitutes an historical landmark in the long fight for the prevention of torture and supposes the creation of a new mechanism –national and independent-
WHICH KIND OF DEPRIVATION OF FREEDOM IN SPAIN WE ARE DEALING WITH?
Will keep in mind in the present report those institutions in which people are deprived of freedom as a result of the application of a measure, act or punishment (whether dictated by an Administrative Authority or a court of the Penal System) and which consist on the physical segregation of an individual, for a certain period of time.
Therefore, it won’t be the object of this investigation those other situations in which the bad or ill-treatments are applied in different contexts from the one specified by the penal system
(Such as gender violence in the domestic field or the violence suffered in other institutions in application of punition as it could happen in the military barracks or hospitals).
The most clear and extensive definition which better delimits the object of investigation comes given from the article 1 of the Convention against Torture and Other Cruel, Inhuman or degrading treatment or punishment (Approved in the Plenary of the United Nations December
10th, 1984 and ratified by Spain, where it entered in force on October of 1987).
“(…), the term ‘torture’ means any act by which severe pain or suffering, whether Physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, When such pain or suffering is inflicted by or at the instigation of or with the consent or Acquiescence of a public official or other person acting in an official capacity. It doe not include pain or suffering arising only from, inherent in or incidental to lawful Sanctions”.
Therefore, the deprivation of freedom for a certain period of time referred by the present Report alludes to the following institutions: prisons, juvenile detention centers for the Detention of foreign nationals, police stations (distinguish in clear and constantly the different Kind of State Security Forces of Spain, as the National Police Force, Civil Guard, Local Police, And the police of Autonomous regions, such Mossos d’Esquadra (airport stations), psychiatric hospitals and other premises for compulsory health treatment (not freely decided).
Finally, to understand what kind of deprivation of freedom we are dealing with, we fully agree with the following statement by the present vice-president of the CPT of the Council of Europe, (2006):
“The area of the deprivation of the liberty is more extensive of whatever thinks. That mainly includes above all the prison that is the place to which it immediately takes the same idea to us of liberty deprivation; a place still and wherever barely is transparent,
to grief that many national orderings anticipate the possibility of access to him of people who have an institutional roll. But the area of the liberty deprivation is not restricted single in the jail. We spoke here of deprivation of the liberty whenever a subject is retained in a place on the part of a public authority – and therefore he is not free to leave
it voluntarily – independently of the cause that such place formally is defined and
Provided as cell or another place with possible lodging (the van that accompanies a person to police station is already then a place of deprivation of the liberty). The guarantees of protection of the fundamental rights of a liberty deprived person go off from the first moment of such deprivation. In particular, the notification to third of the
deprivation of liberty happened, the access to the lawyer and a possible medical checkup, must be guaranteed from the first moment and no, as in more than an occasion some countries have tried to affirm, single from the moment of the formalization of the deprivation of the freedom.”

When we refer to the officials accused, as well as to the preliminary judicial investigations of the accusations, we are setting out the problem of the independence of their investigation or the degree of impunity
and/or of occultation of the torture practices that could allegedly exist in Spain. In the following table we show the cases of officials who have been judicially investigated during the year 2005,

The Council of Europe have stressed the fact that accusations of torture have not always been appropriately investigated, what cast many doubts about the many absolutions and filed cases.

It's stupid to say, as someone does here, that we HAVE to "accept" oppressive systems in other lands.

Today I'm really happy to hear these words of comfort. The day after I wrote the article about police corruption in Spain.I received at my home a fine for an amount of 200 €, totally unjustified and threatening to take me to court if I won't pay.
For too long I've been harassed by the police, I've not only been censored, but also have suffered all manner of insults and slander without having the opportunity to defend myself. Police in my area uses methods of social marginalization and persecution for their prey in order to marginalize social and professional life or manipulating information about people’s lives. They do not hesitate to disclose confidential information when it comes to damage the dignity and integrity of a person.
I'm not quite sure why this is happening to me. It may be for saying some truths in local media, I don’t know, all I know, is that the police are often subjected to the will of political corruption instead of acting independently and justice is also part of this corruption
Sooner or later if I want to live in freedom and dignity I’ll have to leave Spain, this type of moral persecution is invisible to others eyes. While I'm suffering in silence and I think that I can not take it anymore,
I am fully convinced that no one will compensate for the time, money and dignity that I have been stolen. The worst thing for them is that they have not yet managed to destroy me or kill me.

I know perfectly which ones are the harmful attitudes of politicians in my environment, their thefts and their criminal acts, but I do not understand that justice does not act on the evidence of injury harassment and abuse of authority exercised over citizens who have a voice.
Of course they are afraid, afraid of losing his status, for this reason, intelligent people who sees the reality and distrust them, is their enemy. There is a said: “There is nothing more frightful than ignorance in action, this greatest ignorance to reject something they know nothing about, preventing people grow and realize as a person.
Politicians and the police have the need of obedient and submissive people willing to crawl for work and lick the ass of others when necessary to keep the bread, while on the other side, they are engaged in harassing and persecuting those who are not willing to be dominated and manipulated by any ideological interest. If you're not with them, they make your life impossible, as they have been doing to me. It is the law” if you’re not with me are against me”.
So is our repugnant Spanish democracy, now, in crisis.
It’s time to defend and denounce the crimes so many years that me and others have been silent. And I'm willing to use every means at my disposal to do so. I believe that there is still some justice in the world.
